TERMS AND CONDITIONS GOVERNING THE USE OF IMAGES

These terms and conditions apply to any image in which the copyright either resides with the Board of Trustees of the Armouries, or is administered by the Royal Armouries Trading and Enterprises Ltd (RATE)(e.g. Crown Copyright).

The purchase of images does not carry with it any rights to store or reproduce them, or to make them available to the public in any medium or format. Any unauthorised reproduction of RATE’s images constitutes an infringement of copyright and renders those responsible liable for payment of charges and fees in addition to any appropriate damages. Permission to reproduce images is dependent on the full acceptance of these regulations and is automatically abrogated if any part is infringed. Any breech of these regulations renders those responsible liable for payment of charges and fees in addition to any appropriate damages.

GENERAL REGULATIONS

  1. In order to ensure quality control, RATE reserves the right to refuse permission to reproduce any images, if in its opinion they do not meet the appropriate quality control standards and could potentially damage the reputation of the museum.
  2. RATE reserves the publication right in all the images made available through the Image Library, whether or not they have been previously published in any form.
  3. RATE operates a pro-forma invoicing system and payment must be received before any materials and permissions are sent. Payment should be made within 30 days of invoicing, and failure to do so will automatically result in the cancellation of any discounts or special agreements and fees.
  4. On full payment of the invoice, reproduction rights are granted to the Client, as specified on the invoice. Any reproduction of images before full payment of the invoice constitutes an infringement of rights, and renders the Client liable for the payment of damages.
  5. Rights granted by RATE shall be set out in a license and limited to the images listed in the accompanying schedule.
  6. Rights may not be assigned, transferred or sub-licensed by the Client without the prior written consent of RATE.
  7. The Client indemnifies RATE against damages as a result of the unauthorised or defamatory use of the images.
  8. In the event of the Client's insolvency, bankruptcy or death no transfer of ownership in rights or materials from RATE shall be deemed to have occurred other than those properly licensed by the Museum. Materials produced by the Client containing images from RATE shall be considered to be infringing copyright unless rights have been fully paid for and licensed by the Museum. Therefore, such products may not be used to settle the Client's outstanding liabilities without first settling any outstanding invoices due to RATE from the Client.

SPECIAL REGULATIONS

Books, E-books, Journals, Magazines and Newspapers

  1. Rights granted by RATE are strictly limited to the use, period of time and the territory specified on the invoice. All reprints, further editions or reuse of the images in another project require new application and are not covered by the original payment.
  2. RATE reserves the right to request a colour proof of any reproduction of an image prior to printing, and to withhold the right to reproduce an image if the quality of the reproduction falls below the standard set by the Museum.
  3. Images must not be reversed, masked out, cut down, superimposed with type matter or in any way defaced or manipulated without the prior written consent of RATE, Clients who do so will be liable for payment of damages.
  4. Applications to reproduce a detail or a cropped image will only be considered upon receipt of a proof of the reproduction. The caption must include the word 'Detail'.
  5. The Client must credit all images as follows (unless otherwise indicated) © Royal Armouries. Images must not be reproduced without the correct credit line, Clients who do so will be charged additional fees.
  6. The Museum's inventory number must be included in any caption. Clients who reproduce images without the correct inventory number will be charged additional fees.
  7. At least one complimentary copy of each publication must be forwarded to the Royal Armouries for our records. Digital Use such as App, CD-Rom, DVD
  8. Rights granted by RATE shall permit the Client:
    • to include the images in the product
    • to record and/or hold the images as detailed in the schedule on an electronic database under the Client's control for the purposes of developing and producing the product
    • to include the images in a computer programme in the manner detailed in the schedule
    • to reproduce the images once as part of the product for a strictly limited production run and/or until the expiry of the strictly limited licence period
    • to distribute the product within the territory specified
  9. The programme will be designed in such a way that users:
    • will not be allowed to alter, manipulate, or adapt the images
    • extract or make copies of the images
  10. The display of images on-screen shall be accompanied by:
    • a credit, in a place to be jointly agreed, to read (unless otherwise indicated) © Royal Armouries
    • the Museum's inventory number
  11. The Client may not copy or record any version of the images other than those delivered by RATE for this purpose.
  12. Images must not be adapted or altered or in any way manipulated by the Client, without the prior written consent of RATE, Clients who do so will be liable for payment of damages.
  13. The Client shall ensure that any third parties involved in the development or production of the digital content, including subcontractors, are bound by the terms of any license granted by RATE.
  14. The Client shall inform RATE of any unauthorised use of any of the images as soon as it becomes aware of the same.
  15. On the termination of the rights granted by RATE all copies or records of the images made shall be destroyed by the Client, such action to be confirmed to the Museum in writing.

Websites

  1. Rights granted by RATE shall permit the Client:
    • to record and/or hold images as detailed in the schedule on an electronic database under the Client's control
    • to include the images in a computer programme in the manner detailed in the schedule
    • to reproduce the images once as part of the website until expiry of the strictly limited licence period
    • to allow access to the images as part of the website specified in the schedule
    • to allow visitors to the website to browse and view the images
  2. The programme will be designed in such a way that visitors to the website shall not be allowed to:
    • to alter, manipulate, or adapt the images
    • to make copies of the images
    • to access the recordings of the images as individual files during the normal course of using the programme
  3. The display of images on-screen shall be accompanied by:
    • a copyright notice prohibiting the reproduction, transmission, performance, display, rental, lending or storage of the image in any form or in any retrieval system without the written consent of the copyright holders
    • a credit, in a place to be jointly agreed, to read (unless otherwise indicated) © Royal Armouries
    • the Museum's inventory number
    • a hypertext link to the Royal Armouries website, www.royalarmouries.org
  4. The Images shall be scanned at 72 dpi resolution and shall be displayed onscreen at a size not exceeding an area of 300 x 300 pixels.
  5. The Client may not copy or record any version of the images other than thosedelivered by RATE for this purpose.
  6. Images must not be adapted or altered or in any way manipulated without the prior written consent of RATE, Clients who do so will be liable for payment of damages.
  7. The Client shall ensure that any third parties involved in the development, production or maintenance of the website including subcontractors are bound by the terms of any license granted by RATE.
  8. The Client shall inform RATE of any unauthorised use of any of the images as soon as it becomes aware of the same.
  9. The Client shall allow RATE full access to inspect the website for the duration of the agreement and shall supply all necessary passwords free of charge.
  10. On the termination of the rights granted by RATE all copies or records of the images made shall be destroyed by the Client, such action to be confirmed to the Museum in writing.
  11. RATE may revoke the license at any time if the Client is in breach of any of its terms and conditions.

Loan Objects

  1. Applications to reproduce objects on loan to the Royal Armouries Museum should be sent to the Image Library in the first instance. Photographic material may not be sent until the owner has granted their permission and any fees have been paid. RATE does not charge any reproduction fees on loan objects if the owners do so, but will impose a handling charge for administration.

METHOD OF PAYMENT

RATE operates a pro-forma invoicing system and payment must be received before any materials and permissions can be sent. Payment should be made within 30 days of invoicing. All bank charges must be borne by the payee - goods may not be sent if payment is not received in full.

Cheques must be made payable to RATE in sterling.

The Royal Armouries can also accept payment by Visa or MasterCard.

Permission to reproduce objects in the collection will not be granted until all fees have been paid, prior to publication.

Image Library - Refund and Exchange Policy

If you have made an order which is not what you expected or your project has changed. Please contact the licensing team at licensing@armouries.org.uk where we will be happy to refund any image within 30 days from the original purchase date. We can also offer an alternative image file at a manager?s discretion within 90 days of the original purchase date. All refunds will be issued back to the original payment method. Any image that has refunded or exchanged cannot be stored for future use.
